Oregon recently made its DUII laws even tougher. Previously, felony DUII would not be charged unless someone already had three DUI convictions within a 10-year period. Now, if you have had two DUII convictions within a 10-year period, the third DUII can be charged as a Class C felony. There are other driving crimes that can also be charged as felonies. For example, a hit and run involving injuries can be charged as a Class C felony.

Before you are arrested, the police must have probable cause to do so. After reviewing the evidence, we may find that the police had neither a reasonable suspicion nor probable cause.
Further, in DUII cases, the police must ensure that the Breathalyzer test is conducted correctly. When there are errors in how the test was conducted, this evidence is not reliable.
