Although the standard Oregon courts apply for granting restraining orders is that the petitioner must be an intimate partner or family member in fear of physical violence, many restraining orders are based solely on one person's account of the situation.

Judges sign these orders in "ex parte" hearings without the accused present — creating an urgent need for that person to get legal counsel and request a hearing to fight the order. This must be done within 21 days — and violating a restraining order is a serious criminal offense, even if the order is lifted at the hearing.
